Zomba Recording, LLC v. Anthony C. Williams, III p/k/s Tonex, et al., Index No. 600639/06 (Sup. Ct. N.Y. Co. Oct. 23, 2006). Defeated motion to dismiss action concerning breach of exclusive recording agreement by upholding choice-of-forum clause. Obtained injunction barring recording artist from distributing, releasing, marketing and selling sound recordings embodying his vocal and musical performances. In addition, the Court upheld choice-of-law clause rejecting artist's attempt to impose California's labor laws barring personal service contracts for a term more than seven years. Kirk Burrowes v.
